  1. All services provided by Pikcha ("Pikcha") may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any Israeli law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Pikcha from any claims resulting from the use of service which damages the subscriber or any other party.

  2. By using, utilizing and/or visiting Pikcha application, software, services, Facebook page, products and web sites, including all content and functionality available through the Pikcha application or domain (collectively referred to herein as the "Application"), you approve your agreement to these terms and conditions and to the terms of the Pikcha's Privacy Policy (the "Privacy Policy"; and together with these terms and conditions, the "Terms of Service").


  1. Refusal of Service

    1. We reserve the right to refuse, cancel or suspend service, at our sole discretion.

  2. Violations
    Violations of these Acceptable Use Policies should be referred to info@pikcha.com. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.

  3. Account Activation

    1. By activating your account with Pikcha, you agree to the terms of use policies and the disclaimer above. Upon requesting activation of an account, you are required to accept these policies, guidelines and disclaimer.

    2. If you do not agree to any of the Terms of Service, or not complied with them, DO NOT accept the Terms of Service and DO NOT use the Pikcha Application. 

    3. The Pikcha Application is for the use of individuals aged 14 or more. By accepting the terms of service, you affirm that you are more than 14 years of age, and are fully able and competent to consent and agree to, abide by and comply with, the Terms of Service.

    4. You may stop using the Application at any time, without any notice to Pikcha. 

    5. You acknowledge and agree that if any platform on which the Application operates on and/or provided, disables access to your user account, you may be prevented from accessing the Application, including, without limitation, access to your account details or other content which is contained or relates to your user account.


  1. Fees and Services

    1. Pikcha reserves the right to apply charges or fees for the use of certain features thereof, at its sole discretion. Such charges or fees shall not be imposed on a user without receiving his express prior consent and details of the method of payment.

    2. Pikcha reserves the right to apply commission fee for the product or services that purchased using Pikcha application. The prices as shown in the application are the final prices, including all fees and VAT.

    3. Payment method for products and/or services that displayed in Pikcha application is possible only with PayPal online secured payment only.


  1. Intellectual Property Rights

    1. Pikcha does not permit intellectual property rights infringing activities on its Application, and Pikcha will remove all User activity if notified that such User activity infringe on another's intellectual property rights.

    2. Any content placed on, contained in, embedded with or relating to the Application, including without limitation, the graphics, photos, sounds, videos, text, software, scripts, interactive features and the like and the trademarks, trade names and logos, are owned by or licensed to Pikcha and it is subject to copyright and other intellectual property rights (whether those rights happen to be registered or not, and wherever in the world those rights may exist). You are not allowed to make any use of such rights without Pikchas prior written consent.

    3. Nothing in the Terms of Service gives you a right to use any of Pikchas trade names, trademarks, service marks, logos, domain names and other distinctive brand features. You will not remove, obscure, or alter any proprietary rights notices (including copyright and trademark notices) which may be affixed to or contained within the Application.

  1. Pikcha has created this privacy statement in order to demonstrate our firm commitment to privacy. The following discloses the information gathering and dissemination practices for this Application.

  2. Information That We Automatically Logged

    1. Pikcha will collect information, including Personal Information and Non-Identifying Information including information obtained from third parties such as: Personal data of the subscriber that may include: subscriber's name, E-mail; Cookies. Purchase process details: Purchase Date, Purchase amount.

  3. Order Forms

    1. Our site uses an order form for customers to request services. (secured SSL Protocol). We collect sensitive information which is used only for our purpose, no third party receives any type of information from us.

    2. Contact information from the order forms is used to get in touch with the customer when necessary.

  4. Security

    1. We take security measures in place to protect the loss, misuse, and alteration of the information under our control. We use strong SSL encryption to ensure your privacy.

  5. Third Parties

    1. Pikcha uses the services of 3rd parties, such as pikcha customers. Such services may collect personally identifiable and non-personally identifiable information from you. Any third party information collection is under third party's responsibility and under the third party's privacy policies.  

    2. Information collected on this site/application by Pikcha is strictly for our use, NO OTHER OUTSIDE PERSONS MAY VIEW YOUR PERSONAL INFORMATION, Apart from these exceptions:

      1. When a subscriber/user is utilizing by Pikcha customers.

      2. Some information is stored for Pikcha by authorized third-party companies. These companies are carefully selected by us. We limit such third parties in their access to and use of your personal information, and like Pikcha, they will never barter, trade, or sell access to your information.

Acceptable Use Policy

  1. As an operator of a web site, a mobile application and other Internet-related services, Pikcha offers Subscribers and users the means photo print. Pikcha respects that the Internet provides a forum for free and open discussion and dissemination of information. However, when there are competing interests at issue, Pikcha reserves the right to take certain preventive or corrective actions. In order to protect these competing interests, Pikcha has developed an Acceptable Use Policy ("AUP"), which supplements and explains certain terms of each customer's respective service agreement, and is intended as a guide to the customer's rights and obligations when using Pikcha' services. This AUP will be revised from time to time.

  2. One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet's openness and value, but it also places a high premium on the judgment and responsibility of those who use it, both in the information they acquire and in the information they disseminate to others. When subscribers obtain information through the Internet, they must keep in mind that Pikcha cannot monitor, verify, warrant or vouch for the accuracy and quality of the information they acquire. For this reason, the subscriber must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some material posted to the Internet may be sexually explicit or otherwise offensive. Because Pikcha cannot monitor or censor the Internet, and will not attempt to do so, Pikcha cannot accept any responsibility for injury to its subscribers resulting from inaccurate, unsuitable, offensive or illegal Internet communications.

  3. When subscribers disseminate information from the Internet, they must keep in mind that Pikcha does not review, edit, censor or take responsibility for any information its subscribers may create. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation and other harmful speech. Also, because the information created is carried over Pikcha' network and may reach a large number of people, including both subscribers and non-subscribers of Pikcha, subscribers' postings to the Internet may affect other subscribers and may affect Pikcha' goodwill, business, reputation or operations. For these reasons, subscribers violate Pikcha policy and the Service Agreement when they, their customers, affiliates or subsidiaries engage in the following prohibited activities:

    1. Spamming: 
      Sending unsolicited bulk and/or commercial information over the Internet. It is not only harmful because of its negative impact on consumer attitudes toward Pikcha, but also because it can overload Pikcha' network and disrupt service to Pikcha' subscribers. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, Pikcha will investigate and shutdown the account that is SPAMing. A $250 charge for violating this policy will be charged to the person initiating the SPAM.
      Furthermore Pikcha reserves the right to prosecute for this violation. A $1.00 charge will be assessed PER EMAIL sent should Pikcha choose to pursue and prosecute.

    2. Adult-Oriented Content: 
      Pikcha does not allow adult content and will suspend/terminate any offending account.

    3. Obscene Speech or Materials: 
      Using Pikcha' network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material is prohibited. Pikcha is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through its network.

    4. Defamatory or Abusive Language: 
      Using Pikcha' network as a means to transmit or post negative, defamatory, harassing, abusive or threatening language.

    5. Forging of Headers:
      Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.

    6. Illegal or Unauthorized Access to Other Computers or Networks: 
      Accessing, illegally or without authorization, computers, accounts or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking"). Also, any activity that may be used as a precursor to an attempted system penetration (i.e., port scan, stealth scan or other information-gathering activity).

    7. Distribution of Internet Viruses, Worms, Trojan Horses or Other Destructive Activities: 
      Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail bombing or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service or equipment.

    8. Facilitation a Violation of this AUP: 
      Advertising, transmitting or otherwise making available any software, program, product or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mail bombing, denial of service attacks and piracy of software.

    9. Export Control Violations: 
      Exporting encryption software over the Internet or otherwise, to points outside the United States.

    10. Usenet Groups: 
      Pikcha reserves the right not to accept postings from newsgroups where we have actual knowledge that the content of the newsgroup violates the AUP.

    11. Other Illegal Activities: 
      Engaging in activities that are determined to be illegal, including, but not limited to, advertising, transmitting or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards and pirating software.

    12. Other Activities: 
      Engaging in activities, whether lawful or unlawful, that Pikcha determines to be harmful to its subscribers, operations, reputation, goodwill or customer relations.

  4. As we have pointed out, the responsibility for avoiding harmful activities just described rests primarily with the subscriber. Pikcha will not, as an ordinary practice, monitor the communications of its subscribers to ensure that the compliance with Pikcha's policy or applicable law. However, when Pikcha becomes aware of harmful activities, it may take any action to stop the harmful activity, including, but not limited to, removal of information, shutting down a web site, implementing screening software designed to block offending transmissions, denying access to the Internet, or any other action deemed appropriate by Pikcha.

  5. We hope this AUP is helpful in clarifying the obligations of Internet users, including Pikcha and its subscribers, as responsible members of the Internet. Any complaints about a subscriber's violation of this AUP should be sent to info@pikcha.com.
